Welcome to WealthSmith. These Terms of Service (“Terms”) govern your access to and use of the WealthSmith website, waitlist, early-access experience, and any pre-launch features (collectively, the “Service”).
By accessing or using the Service, you agree to be bound by these Terms.

If you do not agree, please do not use WealthSmith.

WealthSmith provides AI-assisted financial insights, goal-based planning, and educational tools to help users understand their crypto portfolios.
The Service is currently non-custodial and read-only:

We never take control of your funds. We never request your private keys.

The Service is not a brokerage, exchange, or financial advisor.

To use WealthSmith, you must:

• Be at least 18 years old
• Have the legal capacity to enter binding agreements
• Use the Service in compliance with these Terms and applicable laws

You may not use the Service if you are on any sanctions list or restricted list.

WealthSmith is strictly non-custodial.

This means:

• We cannot access, move, transfer, or modify your digital assets
• Wallet connections are view-only
• You remain fully responsible for securing your wallet and private keys
• All swaps, staking, or actions are performed manually by you, not by WealthSmith

You acknowledge that you retain full control and responsibility over your assets at all times.

WealthSmith includes an AI assistant (“Smith AI”) and automated insights.

These outputs:

• Are for educational and informational purposes only
• Do not constitute financial, legal, or investment advice
• May occasionally be incomplete, inaccurate, or outdated
• Should not replace your own judgment or consultation with a qualified professional

You are solely responsible for decisions you make regarding your financial assets.

WealthSmith is not:

• A registered investment advisor
• A broker-dealer
• A trading bot
• A financial planning service regulated by any government authority

We do not execute trades, manage portfolios, or guarantee outcomes.

Any actions you take (e.g., swapping, staking, depositing into vaults) are executed outside the platform by you through your own wallet.

If you join the waitlist or create an account:You agree to:

• Provide accurate information
• Not misuse or attempt to circumvent access controls
• Not impersonate others
• Not use the Service for harmful or unlawful purposes

We may contact you with updates, onboarding materials, or invitations to early access programs.

You agree not to:

• Use WealthSmith for illegal activity
• Attempt to hack, disrupt, or overload the Service
• Scrape, reverse-engineer, or copy the platform
• Use automated bots unless explicitly permitted
• Upload harmful content (malware, offensive material, spam)
• Misrepresent WealthSmith or damage its reputation

We reserve the right to suspend or terminate access if these rules are violated.

Your use of the Service is governed by our Privacy Policy, which explains:

• What information we collect
• How we use it
• Your rights regarding your data

We do not sell user data.

We do not collect private keys.

Wallet access, if any, is strictly read-only.

WealthSmith may reference or connect you to:

• Solana DEXs (e.g., Jupiter, Raydium, Orca)
• Staking platforms (e.g., Jito, Marinade, Kamino)
• Yield vaults and external tools

These services are operated by third parties.

WealthSmith does not endorse, audit, or guarantee them.

By using these third-party services, you acknowledge:

• They may carry risk, including loss of assets
• You use them at your sole discretion
• WealthSmith is not liable for their actions, performance, or security

Crypto markets are volatile and involve significant risks.

By using WealthSmith, you acknowledge:

• You may lose value in your assets
• Price data and yield estimates may be inaccurate
• AI recommendations may not reflect real-time market conditions
• Past performance does not predict future results
• You are solely responsible for your investment decisions

WealthSmith provides no guarantees regarding performance, accuracy, uptime, or outcomes.

To the fullest extent permitted by law:

WealthSmith is not liable for:

• Loss of funds
• Market losses or unrealized gains
• Errors or omissions in AI outputs
• Incorrect data displayed by the Service
• Third-party protocol failures
• Smart contract vulnerabilities
• Wallet breaches
• Network outages or downtime

In no event will WealthSmith’s total liability exceed $100 USD, or the minimum amount permitted by law.

You agree to indemnify and hold harmless WealthSmith and its team from any claims, damages, or losses arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your interaction with third-party protocols
• Your financial decisions

We may:

• Update, modify, or discontinue parts of the Service
• Change features or access levels
• Offer or remove early-access programs

We will make reasonable efforts to notify users of major changes.

We may suspend or terminate access to the Service at any time, for any reason, including:

• Security concerns
• Abuse or violation of these Terms
• Legal or regulatory requirements

You may stop using the Service at any time.

These Terms are governed by the laws of the jurisdiction where WealthSmith is incorporated.

All disputes will be resolved in that jurisdiction’s courts.
